February 15 news, according to Bloomberg News, Apple today asked the bankruptcy court to allow it to sue the Eastman Kodak company, accusing the latter of infringing printers, digital cameras and digital photo frame-related patents.
In a filing filed with the Bankruptcy Court in New York, Apple said that it hoped to file a lawsuit against Kodak at the US International Trade Commission and filed a patent infringement suit in the Manhattan District Court in New York. The document stated that Apple hopes to prevent Kodak’s infringement through lawsuits.
Apple lawyer wrote in the paper that, although the bankruptcy law does not prohibit infringement proceedings against companies under the protection of the court, but for prudent reasons, Apple hopes that the court can express its attitude before the lawsuit is filed.
Apple stated that Kodak has the right to withdraw its lawsuit before the International Trade Commission decides.
Kodak filed suit against Apple and RIM not long ago and accused the companies of infringing a number of patents including image previews. Apple said that he is the real holder of image preview patents.
Apple claims that it invented the digital camera in the early 1990s and shared the technology with Kodak. Kodak then applied for a patent for this technology. Kodak denied this.
